PRIVACY POLICY

Thank you for visiting a The Jo Maxwell Show (“we” or “us”) offering. This Privacy Policy explains our online information practices and the choices you can make about information collected through our websites, services, and applications (each a “Site” or collectively, the “Sites”). This Privacy Policy applies to any Site that links directly to this policy. For certain offerings on our Sites, there may be additional notices about our information practices and choices. Types Of Information We Collect
We may collect different types of information during your interactions with our Sites. This information may include personal information (e.g., name, phone number, postal address, email address, and certain payment information), technical information (e.g., technical information, including device identifier, IP address, browser type, operating system) and usage information (e.g., how you use and navigate to and from our Sites, and information about content or advertisements you have been shown or have clicked on). We may combine these types of information together, and collectively refer to all of this information in this Privacy Policy as “Information.” Information may be collected as described below and through the use of cookies, web beacons, pixels, and other similar technologies. Below we describe the types of Information we may collect:
- Registration, account, and sign-up information. We may collect Information in the course of your use of, or registration with, our Sites. For example, when you create an account, register for or download an application, or sign-up for a product or service, you may provide us with certain personal information. This type of personal information may include: name, phone number, postal address, fax number, email address, or certain payment information (e.g., credit card and billing information). We may also receive Information about your interest in and use of various products, programs, services, and content available on or through our Sites.
- Information about others/inviting friends. On some of our Sites, we may collect Information you submit about other people. For example, you might submit Information to invite a friend to participate in an offering, make recommendations, or share content. By processing these requests, we may receive the other person’s Information, including a recipient’s name, postal address, email address, telephone number, or information about the recipient’s interest in and use of various products, programs, services, and content. Some of our Sites also allow you to invite your friends to participate in activities by providing their contact details or importing contacts from your address book or from other sites.
Information from other sources. We may, on occasion, combine Information we receive online with other Information, including usage Information from our other Sites. We may also supplement or combine Information with Information from other sources or outside records, such as demographic information, and use that combined Information in accordance with this Privacy Policy.
- Information that is collected from Social networks and publicly available data. You can engage with some of our content and offerings on or through third party communities, forums, and social media sites, services, plug-ins, and applications (“Social Media Sites”). When you link to or interact with our Sites or content through Social Media Sites (for example Facebook ‘like’ button), you may allow us to receive certain Information from your social media account (e.g., name, user ID, email address, profile photo, photos and videos, gender, birthday, location, your list of friends and their contact details, people you follow and/or who follow you, the posts or the ‘likes’ you make). We may also receive Information from your interaction with our content (e.g., content viewed, high scores, and information about advertisements you have been shown or have clicked on). By providing this Information or otherwise interacting with our Sites through Social Media Sites, you consent to our use of Information from the Social Media Site in accordance with this Privacy Policy. If you don’t want a social network to collect the information about you as described above, or you don’t want a social network to share it with us and other third parties, please review the privacy settings and instructions of the applicable social network before you visit and use our online services
Public forums. If you post or share Information or content, such as photos, letters, videos, or comments, while participating in online forums on our Sites, or when you interact with our Sites through Social Media Sites, depending on your privacy settings this Information and your username may become public on the Internet or within a community of users. We cannot prevent further use of this Information once it is made public. - Location information. We may have access to certain Information about your location, such as your country or address, when you provide it or via device information (such as an IP address). If you access our Sites on your mobile device we may collect Information about your device’s precise location.
HOW WE COLLECT YOUR INFORMATION
The methods we use to collect information about you are as follows:
- Directly from you, when you provide it to us: for example, when you request products or services from us, when you register with us, respond to surveys, apply for a job, contact us or otherwise interact with us. Please remember that if others use devices into which you remain logged in, they may share information with us as if they were you, and they may have access to information that you have previously provided us. To protect your privacy, please log out from our online services that you access from public or shared devices.
- Automatically, when you use our online services: information collected through the use of Cookies and Other Technologies, and when you download our Mobile Apps. - From third parties: including social networks, other online services, publicly available records, our service providers and from consumer data resellers.
HOW WE USE THE INFORMATION WE COLLECT
We (and our service providers) use information to:
- provide the online services you have requested;
- enter you into sweepstakes, contests or promotions where requested;
- create an online services account if you have requested one;
- personalize the services offered by us or our affiliates, including providing personalized advertising on some online services (see options for opting out of personalized advertising here);
- respond to your inquiries, requests, and comments;
- allow you to participate in the interactive features of our online services, where you choose to do so;
- provide technical support for our online services;
- prevent fraud or potentially illegal activities (including copyright infringement) on our online services;
- protect the safety of users and others on our online services;
- enforce our online services’ terms of service;
- understand how our online services are used so that we can continuously improve them, and the services we provide to you;
- send you newsletters and information about products, services and promotions relating to us and/or our business partners or other organizations that we work with, in accordance with your communication preferences.
- send you service-related communications, including announcements and administrative messages;
- create anonymous and, where legally permissible, personally identifiable user and consumer profiles, and audience segments that can be used for targeted advertising and marketing, and subject to legal restrictions (including consent where necessary) we may also use technology (such as Facebook Custom Audiences) to deliver advertising to you on other sites and in Mobile Apps based on the email address or other personal information you provide to us or through the use of information we receive from third parties, including Consumer Data Resellers. If you use our online services to send gifts we use the contact information (e.g., email addresses) that you provide to send the gift to your requested recipients, provide other communications relating to those sorts of transactions, as well as any further communications as may be authorized by the recipients; and implement any related social networking features you have activated.
Note that we may combine all the information we collect or receive about you for any of the foregoing purposes.
HOW WE SHARE YOUR INFORMATION
With Whom We May Share Information
Information sharing within JMS and among JMS affiliates. Your information may be shared with JMS affiliates, and used to help us better tailor our services, products and advertising to you. Information sharing with third parties – e.g. service providers, advertisers, consumer data resellers, social networks: We do not share your personal information with third parties for those third parties’ marketing purposes unless you opt-in to such sharing at the time you provide your personal information. We may share non-personal information, such as aggregate user statistics, demographic information, and web site usage information with third parties. In addition, we may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the circumstances described below.
Third Parties Providing Services On Our Behalf
We employ third parties to perform functions on our behalf; examples include hosting or operating the Web Site, sending e-mail and/or other communications, providing wireless services, removing repetitive information from customer lists, data analysis, marketing assistance, and customer service. These third parties may have access to information collected by Company, including without limitation your personal information, for the purpose of performing such functions on the Web Site’s behalf.
When You Agree To Receive Offers From Third Parties
Third party(s) may present you with an opportunity to receive information and/or marketing offers. If you do not agree to have your personal information shared, we will not share your personal information with such third party(s) for direct marketing purposes. If you do agree to have your personal information shared, then we may disclose your personal information to such third party(s). All information we disclose as well as all information you provide directly to such third party(s) will be subject to the privacy policy and practices of such third party(s). We are not responsible for the privacy policies and practices of such third party(s) and, therefore, you should review the privacy policies and practices of such third party(s) prior to agreeing to receive communications from such third party(s) and prior to agreeing disclose such information to such third party(s). If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.
Newsletter
Our Newsletters are periodically sent to users who have previously registered to receive such material. The information obtained during registration (e.g. email address) is securely stored to achieve a more tailored relationship with Company. At any time, user can “unsubscribe” to this service.
User Forums
The Web Site may make User Forums available to its users or provide links to other third party web sites where Company maintains a related content web page(s) which may include forums, message boards, chat rooms, online diaries, social networking areas, or other interactive areas (“Third Party User Forums”). If you post comments, photographs, videos (including web cam videos), music, text or other content on any User Forums or Third Party User Forums, whether or not such postings include personal information, they will generally be publicly available (except in certain circumstances, such as “non-shared” user diaries) and you may receive unsolicited messages from other parties. We cannot ensure the security of any information you choose to make public in a User Forum or Third Party User Forum. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when disclosing personal information in these areas. Your use of User Forums is at your own risk and is subject to our Terms of Use and any applicable Additional Terms. Your use of Third Party User Forums is subject to such third party’s privacy policy and terms of use.
Third-Party Advertisers, Links To Other Sites
Company allows other companies, called third-party ad servers or ad networks, to serve advertisements within the Web Site. For example, if you “click” on a banner advertisement, the “click” may take you off the Web Site onto a different web site. This includes links from advertisers, sponsors and partners that may use the Web Site’s logo as part of a co-branding agreement. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Web Site. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. Company does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks Company to show an advertisement to a certain audience (for example, women ages 18-34) or audience segment (for example, women ages 18-24 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the Web Site, such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. This Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with Company is maintained and dealt with by Company in accordance with this Privacy Policy.
Information Sharing With Other Parties:
In addition, we may disclose your personal information to law enforcement agencies, government/regulatory bodies, and content protection organizations to:
- Protect our legal rights, privacy or safety, and that of our subsidiaries, affiliates, employees, agents, contractors, or other individuals;
- Protect the safety and security of visitors to our online services or other properties;
- Protect against fraud or other illegal activity or for risk management purposes;
- Respond to inquiries or requests from government, regulatory, law enforcement, or public authorities;
- Permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages that we may sustain;
- Comply with the law including with subpoenas, search warrants, court orders, and other legal process; or
- Enforce applicable terms of service.
- Sale or transfer of all or part of our business or assets
We reserve the right to transfer the information described in this Privacy Policy in the event we sell or transfer all or a part of our business or assets so that the buyer can continue to offer you the online services. We will make commercially reasonable efforts to provide you with reasonable notice of such transfer, or as otherwise required by law. If you do not want your personal information to be processed following such a transfer, you should contact the subsequent owner of the business
COOKIES AND OTHER TECHNOLOGIES
The Web Site uses standard technology called “cookies” which are small data files or strings of text that are transferred to your computer (or other Internet-accessing device) when you visit the Web Site and allow your browser to accept cookies. Cookies automatically identify your web browser to the Web Site whenever you visit the Web Site and may make navigating and using the Web Site easier for you. Additionally, accepting cookies may allow you to, among other things; personalize your experience on the Web Site. Company may from time to time use both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Web Site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, please be aware that some areas of the Web Site may not provide you with an acceptable user experience if you have disabled the use of cookies.
CHILDREN’S PRIVACY
Visitors to this Site may participate in many activities without providing any personal information. However, in some cases if a user wants to participate in certain of our interactive features, we may ask the user to register and/or provide us with the user’s age information and, in some cases, email address. If the person who registers indicates that he or she is under 13 years old, as permitted by law we will (i) collect no or limited personal information (e.g. email address only) from that individual, (ii) inform the child that a parent’s verifiable consent is required, and/or (iii) collect the email address of the user’s parent in addition to the user’s email address. We use the parent’s email address to seek the parent’s verifiable consent or notify the parent of his/her child’s online activities and enable the parent to unsubscribe his/her child from a newsletter or other similar activity. Once a parent provides consent, we may use any information from the child consistent with the rest of this Privacy Policy and/or the terms of the consent provided by the parent. If a user is under 13, we will not condition his/her participation in an online activity on the disclosure of more personal information than is reasonably necessary to participate in the activity. INTERNATIONAL TRANSFER
We operate internationally, and many of our computer systems are currently based in the United Kingdom, this means Information we collect will be processed by us in the UK. where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you use or visit our Sites from outside the United Kingdom, you consent to the collection and/or processing in the United Kingdom of Information we collect from you.
YOUR RIGHTS AND CHOICES
Communication Preferences and Opt-outs
If you have subscribed to one or more of our email newsletters or are receiving them from us and you don’t want them anymore, you can unsubscribe. Select the “unsubscribe” link at the bottom of any message, by other means provided to unsubscribe, or using the contact details below, to unsubscribe from marketing and promotional emails and associated marketing delivered to you on third party services based on your subscription data. However, you cannot unsubscribe from some service related messages.
UPDATES TO OUR PRIVACY POLICY
From time to time, we may revise this Privacy Policy to reflect industry initiatives, changes in the law or technology, or changes in our practices regarding information collection and use. If we make material revisions to the way we collect or use your personal information so that we are using it for purposes or sharing data with third parties that you have not consented to, we will provide you with notice of those changes and may do so by either: (1) announcing the change on the home page of our websites or (2) taking other actions as we deem appropriate under the circumstances, including without limitation, posting the revised version of this Privacy Policy online. You agree that we may notify you about material changes in the way we treat personal information by placing a notice on our online services.
